Privacy Policy for Photo 4K AI

This Privacy Policy describes how Photo 4K AI ("the App", "we", "us", or "our") collects, uses, and discloses your information when you use our mobile application. The App is developed and operated by Mert Eren ("Developer"). By downloading, installing, or using Photo 4K AI, you agree to the practices described in this Privacy Policy.

1. Information We Collect

1.1 Photos You Provide

Photo 4K AI allows you to enhance photos using artificial intelligence. When you choose a photo from your device's photo library or capture a new photo, that photo is uploaded to our processing infrastructure for the sole purpose of generating an AI-enhanced version. We do not access, scan, or upload any photos that you do not explicitly select within the App.

1.2 Anonymous Authentication Data

To enable subscription tracking, abuse prevention, and saving your enhancement history across sessions, the App uses Firebase Anonymous Authentication (provided by Google). This generates a random, anonymous identifier on your device. This identifier is not linked to your name, email address, or any directly identifying information unless you choose to add such information.

1.3 Subscription and Purchase Data

Subscriptions, in-app purchases, and credit top-ups are processed through Apple's App Store and managed in our backend by RevenueCat. We receive transaction status, subscription tier, renewal dates, and an anonymized RevenueCat user identifier. We do not receive your full payment card information, Apple ID password, or any other sensitive financial credentials — that data stays with Apple.

1.4 Usage Analytics and Diagnostic Data

We collect non-personally identifiable usage data such as which features are used, how often the App is opened, crash reports, error logs, performance metrics, and approximate session durations. This data helps us improve App performance and reliability.

1.5 Device and Technical Information

We automatically collect basic technical information including device model, operating system version, App version, language preference, and a non-persistent device advertising identifier where available. This information is used for compatibility, debugging, and aggregate analytics.

1.6 Photos Containing Faces — Face Data Disclosure

Photo 4K AI is a general-purpose photo enhancement application. When you submit a photo for enhancement, that photo is processed as a single, complete image — it is not analyzed for face-specific features, biometric identifiers, or identity recognition. Specifically:

  • We do not collect, generate, or store face data. The App does not extract facial landmarks, face geometry, face embeddings, faceprints, biometric templates, or any other face-derived identifiers from the photos you submit.
  • We do not use Apple's face-related APIs. The App does not use ARKit face tracking (ARFaceTrackingConfiguration), Vision face detection (VNDetectFaceLandmarksRequest, VNFaceObservation), or any other facial-analysis framework provided by iOS. The App does not use Face ID, Touch ID, or any other biometric authentication API.
  • No facial recognition or identification. The AI enhancement pipeline (Google Gemini) processes the photo as a whole image to improve overall sharpness, clarity, and detail. It does not identify individuals, match faces against any database, or build a face profile.
  • No third-party face sharing. We do not share faces, photos, or any face-derived data with advertisers, data brokers, analytics providers, or any third party for marketing, training, profiling, or identification purposes. The only third party that ever processes the photo is the AI provider (Google Gemini) for the sole purpose of producing the enhanced image.
  • Retention is identical to all other photos. If a photo you submit happens to contain a face (e.g. a portrait), it is stored and deleted under exactly the same policy as any other photo (see Section 3 below): automatically deleted from our servers within 60 days.
  • No training on your photos. Neither we nor our AI provider use your photos (with or without faces) to train, fine-tune, or evaluate any AI model.

This disclosure is provided to make our handling of photos containing faces fully transparent, consistent with Apple App Store Review Guideline 5.1.1 and 5.1.2(vi).

2. How We Use Your Information

  • To process and deliver AI-enhanced versions of the photos you submit
  • To provide, maintain, and improve the App's features and functionality
  • To manage subscriptions, credit balances, and verify entitlements
  • To prevent fraud, abuse, and unauthorized access
  • To diagnose technical issues and improve performance
  • To comply with applicable legal obligations

3. Photo Processing and Retention

Photos that you submit for enhancement are uploaded to secure cloud storage (Cloudflare R2) and processed by our AI provider (Google Gemini AI). Once processing is complete, both your original photo and the enhanced output are automatically deleted from our servers within 60 days. Enhanced results are also delivered back to your device, where you can save them to your photo library at your discretion.

We do not use your photos to train AI models, and we do not share your photos with any third party other than the processing services strictly required to deliver the enhancement. This applies to all photos equally, including photos that contain faces (see Section 1.6 above for the explicit face-data disclosure).

Consent before sharing with our AI provider. Before your photo is sent to Google Gemini AI for enhancement, we obtain your explicit, in-app consent. A consent screen inside the app discloses exactly what is sent (the selected photo), who processes it (Google Gemini AI, operated by Google LLC), and how long it is retained, and you must tap "I Agree" before any photo leaves your device. If you tap "Cancel", no photo is sent. You can withdraw this consent at any time in the app's Settings ("Revoke AI Consent"), after which you will be asked to consent again before your next enhancement.

4. Third-Party Service Providers

We rely on the following third-party providers to operate Photo 4K AI. Each provider only receives the data strictly necessary to perform its function:

Equal protection of your data. Each third party listed above provides protection of your data that is equal to or greater than the protection described in this Privacy Policy, under its own published privacy terms. In particular, your photo is shared with Google Gemini AI — a third-party AI service operated by Google LLC — solely to perform the image enhancement you request. Google processes the photo under the Google Privacy Policy and does not use it to train its AI models. We share your photo with this third-party AI service only after you have given explicit in-app consent (see Section 3).

5. Data Storage and Security

We use industry-standard technical and organizational measures to protect your information, including TLS encryption in transit, encryption at rest where supported by our providers, restricted access controls, and a least-privilege approach to internal access. While no method of transmission or storage is 100% secure, we work continuously to safeguard your data.

6. Your Rights Under GDPR (European Users)

If you are located in the European Economic Area (EEA) or the United Kingdom, you have the following rights under the General Data Protection Regulation (GDPR):

  • Right of access: Request a copy of the personal data we hold about you
  • Right to rectification: Request correction of inaccurate data
  • Right to erasure ("right to be forgotten"): Request deletion of your data
  • Right to restrict processing: Request limits on how we process your data
  • Right to data portability: Receive your data in a structured, machine-readable format
  • Right to object: Object to processing based on legitimate interests
  • Right to withdraw consent: Withdraw consent at any time, where processing is based on consent
  • Right to lodge a complaint with your local data protection authority

7. Your Rights Under CCPA (California Residents)

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with specific rights regarding your personal information:

  • The right to know what personal information we collect, use, and disclose
  • The right to request deletion of your personal information
  • The right to opt out of the sale of personal information (we do not sell personal information)
  • The right to non-discrimination for exercising your CCPA rights

8. Children's Privacy

Photo 4K AI is not directed to children under the age of 13 (or under 16 in the EEA). We do not knowingly collect personal information from children. If you are a parent or legal guardian and believe your child has provided us with personal information, please contact us at erenmert9@gmail.com and we will promptly delete the data.

9. Account and Data Deletion

You may request deletion of your anonymous account, subscription history, and any associated data at any time by emailing erenmert9@gmail.com from the device or providing your anonymous user ID (available in the App's Settings screen). We will process the request within 30 days. Note that deleting your account does not automatically cancel your subscription — please cancel through Apple's App Store subscription settings.

10. International Data Transfers

The third-party providers we use (Google, RevenueCat, Cloudflare) may store and process data in the United States and other countries outside your country of residence. Where required, these transfers are protected by Standard Contractual Clauses or other lawful transfer mechanisms.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal reasons. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by an in-App notice. Your continued use of the App after changes become effective constitutes acceptance of the revised Privacy Policy.
